What is the Purpose of a Class Action Lawsuit?A class action lawsuit refers to a court case brought by a single person on behalf of a group of people or accusations made by a group of people against a person who could be a corporate or private entity. A lawsuit allows a large number of aggrieved parties with a common interest in a relationship to sue or be sued as a group (Benton, 2005). The purpose of a class action lawsuit is to give the common man the ability to challenge large corporations or private entities who can afford the best legal services and seek targeted compensation for any wrongs done to them by private entities. What are the requirements to have a certified class? The requirements for obtaining a certified class are set forth in Rule 23 of the Federal Rules of Civil Procedure. The designed class must meet the general standards for class certification. The judge will have to define the scope and characteristics of this class, thus certifying the plaintiff as a class. Plaintiffs must share a common complaint while defendants are required by law to share a similar defense for all plaintiffs. Potential plaintiffs must be notified of the class action through various avenues such as mail, telephone calls, or television advertising depending on the capacity of the proposed class. A judge must select highly experienced counsel for the plaintiff and make arrangements with the plaintiff's counsel for the distribution of damages. The judge should also give plaintiffs the opportunity to “opt out” of the proposed class action before the proposed class is certified (Benton, 2005). Secondly, whether the shock was due to the simultaneous observation of the accident. Third, whether the complainant and victim had a close relationship (Kelly, Holmes, & Hayward, 2005). Both defendants, Jaffees and Atlantic, are both liable. Damages caused by emotional distress caused to the plaintiff are recoverable using the factors indicated above. The actor was right at the scene of the accident (Benton, 2005). Furthermore, she saw her boyfriend suffer helplessly until she left. Furthermore, the appellant was the mother of the victim. The plaintiff suffered emotional distress that deserves compensation from the defendants. References Kelly, D., Holmes, A. E. M., & Hayward, R. (2005). Commercial law. London: Cavendish.Benton, B.
