The Thailand-Australia Free Trade Agreement (TAFTA) was signed on 5 July 2004 and entered into force on 1 January 2005. This agreement aims to ensure greater access to Australian products, improves prospects for services trade and investment, improves the regulatory environment and promotes greater business mobility. This report focuses on two sections which include immigration policy and the transfer of funds and earnings from Thailand to Australia. Immigration Policy under the Free Trade Agreement The immigration policy under TAFTA provides for the temporary entry of natural persons who are required to perform an undertaking for commercial purposes. The individual must be a citizen or permanent resident of Australia. This individual must be employed by or have signed a service contract with a company registered in Australia or Thailand. Furthermore, this person should also meet the immigration formalities criteria to be eligible to receive a temporary entry visa. The eligibility and duration of each stay depends on the different business purpose.1. Business Visitors: Thailand does not require a work permit for Australian citizens who are business visitors conducting business meetings in Thailand for up to 15 days and up to 90 days for APEC Travel Card holders. This condition is available to the service seller, the investor and natural persons working for an investor. Service sellers or service company sales representatives are people who want to visit Thailand to transact business without making direct sales to the public or providing services directly. Those Australian investors look for investment opportunities in the territory of Thailand. They can also be natural persons employed by an investor seeking to make investments in the territory of Thailand.2. Intra-company transfers: Thailand will grant a visa and work permit for a maximum stay of five years to all Australian citizens transferred to work in Thailand within the same company. The visa and work permit will be renewed annually. These people should work only as managers, executives or specialists.3. Contractual Service Providers - Thailand will grant a visa and work permit for a maximum stay of three years to all Australian citizens entering Thailand to work under a contract with an Australian or Thai company. The visa and work permit will be renewed annually. Again, these people should only work as managers, executives or specialists.
